On January 4, the EPA published a Proposed Rule (the “Proposed Rule”) that proposes to decrease annual HCFC-22 consumption allocations relative to the EPA’s December 2009 final rule (the “2009 Final Rule”) by a range of between 11 and 47 percent for calendar years 2012, 2013 and 2014. The Proposed Rule is not final and the EPA will be taking comment before issuing a final rule. Until the issuance of a final rule governing 2012 HCFC-22 allowances, the EPA’s No Action Assurance limits the production and/or importation of HCFC-22 in 2012 to an amount equal to the maximum reductions proposed by the EPA in the Proposed Rule, representing approximately a 45% reduction from what was allowed to be produced and/or imported in 2011.  The immediate impact of this ruling has been more than a 100% increase in the counter price of R-22.  When you are replacing your expired HVAC equipment, now more than ever it makes sense to use AES Reclaim to recycle the commodities and bank your old refrigerant.
